Terms & Conditions

Please read these terms carefully before enrolling in or using any Texas Driving School service.

Important Notice These Terms and Conditions constitute a legally binding agreement between you ("Student," "Parent," "Guardian," or "User") and Texas Driving School ("Company," "we," "us," or "our"). By enrolling, making a payment, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

1 Acceptance of Terms

By accessing our website at txdrivingschools.com, enrolling in any course, scheduling a driving lesson, or utilizing any service provided by Texas Driving School, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not enroll or use our services.

If you are enrolling a minor (under the age of 18), the parent or legal guardian must review and accept these terms on the student's behalf. The parent or guardian is responsible for compliance with all terms as they relate to the minor student.

2 Services Offered

Texas Driving School provides the following services in the state of Texas, subject to applicable state licensing and regulations:

  • Teen Driver Education – State-approved classroom and behind-the-wheel instruction for drivers ages 14–17
  • Teen Online Driver Education Course – Texas-approved online driver ed for teens
  • Adult Driver Education – Classroom and practical instruction for first-time adult drivers (18+)
  • Adult Online Driver Education Course – Online driver ed for adults 18 and older
  • Behind-the-Wheel (BTW) Driving Lessons – Private in-car instruction with a licensed instructor
  • DPS Authorized Road Test – Third-party road skill testing services
  • Defensive Driving Course – TDLR-approved course for ticket dismissal or insurance discount
  • Impact Driver Course – Online safety awareness program
  • Teen & Adult Classroom Courses – In-person classroom instruction

Texas Driving School is licensed by the Texas Department of Licensing and Regulation (TDLR) and operates in accordance with Texas Education Code and the Texas Administrative Code, Title 16, Chapter 84.

3 Enrollment & Eligibility

Teen Driver Education: Students must be at least 14 years of age at the time of enrollment. Parent or guardian consent is required for all students under 18. A valid learner's permit or eligibility documentation may be required prior to beginning behind-the-wheel instruction.

Adult Driver Education: Students must be 18 years of age or older. A valid government-issued photo ID must be presented upon enrollment and at each scheduled lesson or class.

DPS Road Test: To be eligible for a DPS Authorized Road Test, students must hold a valid Texas Learner License and must have held it for the minimum required period as mandated by TDLR and the Texas DPS.

General Requirements:

  • All students must provide accurate, truthful information at the time of enrollment.
  • Students with physical or medical conditions that may affect their ability to safely operate a motor vehicle must disclose such conditions prior to enrollment.
  • Texas Driving School reserves the right to refuse enrollment or remove a student from a course if it determines, in its sole discretion, that the student's participation poses a safety risk or the student does not meet eligibility requirements.
  • Enrollment is not complete until payment in full (or an approved payment arrangement) has been received.

4 Fees & Payment

All fees are listed on our website at txdrivingschools.com and are subject to change without notice. The price in effect at the time of enrollment applies to that enrollment.

Accepted Payment Methods:

  • Credit and debit cards (Visa, Mastercard, American Express, Discover)
  • Zelle
  • Cash (in-person only)
  • Other methods as listed on our website at the time of purchase

Payment Terms:

  • Full payment is due at the time of enrollment unless a payment plan is explicitly offered and agreed upon in writing.
  • Returned checks or failed electronic payments will incur a $35 returned payment fee.
  • Accounts with outstanding balances may have services suspended until the balance is cleared.
  • All prices are in U.S. dollars and do not include applicable taxes, if any.
Note: DPS road test fees paid directly to the Texas DPS are separate from and in addition to Texas Driving School fees. We have no control over DPS fees.

5 Cancellation Policy

We understand that schedules change. Please review our cancellation policy carefully:

Behind-the-Wheel Lessons & Road Tests:

  • Cancellations made 48 hours or more before a scheduled appointment will incur no fee.
  • Cancellations made 24 to 48 hours before a scheduled appointment will result in forfeiture of a $25 cancellation/rebooking fee.
  • Cancellations made less than 24 hours before a scheduled appointment, or no-shows, will result in forfeiture of the full lesson or road test fee for that session.
  • Repeated no-shows (3 or more) may result in removal from our program without a refund.

Classroom Courses:

  • Cancellations prior to the first class session are eligible for a full refund (see Refund Policy).
  • Cancellations after the course has begun are subject to the refund schedule outlined in Section 6.

Online Courses:

  • Once an online course has been activated or accessed, cancellation is subject to the refund policy in Section 6.
Weather & Emergency Cancellations: Texas Driving School reserves the right to cancel or reschedule any appointment or class due to severe weather, instructor illness, mechanical failure, or other unforeseen circumstances. In such cases, students will be rescheduled at no charge. No refund will be issued solely due to a school-initiated reschedule.

6 Refund Policy

All refund requests must be submitted in writing to [email protected] or in person at our office. Refunds will be processed within 10 business days of approval to the original payment method.

Driver Education Courses (Teen & Adult):

  • Cancellation before course start: 100% refund, less a $25 administrative fee
  • Cancellation after completing up to 25% of the course: 75% refund of tuition paid
  • Cancellation after completing 26%–50% of the course: 50% refund of tuition paid
  • Cancellation after completing more than 50% of the course: No refund

Behind-the-Wheel (BTW) Lesson Packages:

  • Refunds for unused lessons in a package will be prorated based on the per-lesson rate of the package, less any lessons already taken and any applicable cancellation fees.
  • No refund for partially completed lessons.

DPS Authorized Road Tests:

  • Road test fees are non-refundable once the appointment has been confirmed with DPS, except in cases of school-initiated cancellation.
  • If you fail the road test, no refund is issued; you may rebook at the applicable rate.

Online Courses:

  • If the course has not been accessed: 100% refund, less a $10 processing fee
  • If the course has been partially completed: No refund once login credentials have been issued and the course accessed

Defensive Driving Course:

  • Refunds are available only before the course is accessed. No refund after login and course access.
Non-Refundable Items: The following are non-refundable under all circumstances: processing fees, administrative fees, no-show fees, state-required filing fees, and any fees paid directly to the Texas DPS.

7 Rescheduling

Students may reschedule appointments subject to availability:

  • Rescheduling requests made 48 or more hours in advance are free of charge.
  • Rescheduling requests made with less than 48 hours notice will incur a $25 rescheduling fee.
  • Rescheduling is permitted a maximum of three (3) times per booking; subsequent rescheduling requests may be denied or treated as a new booking at current rates.
  • Students who fail to provide timely notice of reschedule and do not attend a scheduled session will be treated as a no-show (see Section 5).

8 Student Conduct

Texas Driving School is committed to maintaining a safe, respectful, and productive learning environment. All students are expected to:

  • Arrive on time and prepared for all scheduled sessions
  • Follow all instructions given by their instructor or course administrator
  • Treat instructors, staff, and other students with courtesy and respect
  • Refrain from using a mobile phone or other electronic device (except as required for online courses) during driving lessons
  • Arrive for lessons in a fit condition — free from the influence of alcohol, drugs, or any substance that impairs judgment or physical ability
  • Dress appropriately, including wearing closed-toe shoes during behind-the-wheel sessions
  • Not bring unauthorized passengers to behind-the-wheel sessions
Grounds for Immediate Dismissal: Texas Driving School reserves the right to immediately terminate a student's enrollment, without refund, if the student: (a) appears intoxicated or under the influence of any substance; (b) engages in threatening, abusive, or violent behavior toward staff or others; (c) deliberately damages school property; or (d) refuses to comply with a lawful instruction that affects the safety of the lesson. In such cases, the student will be responsible for any damage to school property.

9 Vehicle Use & Liability

Texas Driving School vehicles are provided for in-car instructional use only. The following terms apply when a school vehicle is used:

  • Students must be enrolled in an active behind-the-wheel program to use a school vehicle.
  • The student must possess a valid Texas Learner License or other applicable permit at all times during a lesson in which they are operating the vehicle.
  • Students shall not operate the vehicle outside of the parameters established by the instructor.
  • Any damage to the school vehicle caused by the student through negligence, recklessness, or willful misconduct will be the financial responsibility of the student (or, if a minor, the student's parent or legal guardian).
  • Normal wear and tear is expected and will not be charged to the student.

Insurance: Texas Driving School maintains commercial vehicle insurance for all instructional vehicles. However, this insurance does not cover personal injury or property damage arising from a student's gross negligence or intentional acts.

Student's Own Vehicle: Texas Driving School does not accept liability for any damage to or arising from the use of a student's personal vehicle during a lesson. Students wishing to use their own vehicle for lessons must obtain prior written approval and provide proof of insurance.

10 Certificates & Records

Upon successful completion of an applicable course, Texas Driving School will issue a Certificate of Completion or submit electronic records to the Texas DPS as required by law.

  • Certificates are issued only upon full payment of all applicable fees and successful completion of all course requirements, including minimum attendance hours where required by TDLR.
  • Certificates for teen driver education are submitted electronically to the Texas DPS on the student's behalf.
  • Replacement certificate requests are available for a $15 administrative fee.
  • Student records will be maintained in accordance with TDLR requirements for a minimum of three (3) years.
  • Texas Driving School is not responsible for delays in DPS processing of submitted completion records.

11 Online Course Terms

The following additional terms apply to all online course offerings:

  • Access: Online course access is granted to the individual who enrolled. Login credentials are non-transferable and may not be shared.
  • Technical Requirements: Students are responsible for having a compatible device, stable internet connection, and updated browser. Texas Driving School is not responsible for technical failures on the student's end.
  • Identity Verification: Online courses may include periodic identity verification as required by state regulations. Failure to complete verification steps may result in course suspension.
  • Course Expiration: Online course access expires one (1) year from the date of purchase unless otherwise stated. No extensions or refunds will be granted for expired access.
  • Cheating/Fraud: Completing course content on behalf of another person, using automated means to advance through course material, or any form of academic dishonesty is strictly prohibited and may result in immediate course cancellation without refund, and reporting to the applicable regulatory authority.
  • Browser/Device: We recommend Google Chrome or Mozilla Firefox for the best experience. Texas Driving School is not liable for course performance issues related to unsupported browsers or devices.

12 Privacy Policy

Texas Driving School is committed to protecting your personal information. This section summarizes how we collect, use, and safeguard your data.

Information We Collect:

  • Name, date of birth, contact information (phone, email, address)
  • Driver's license or learner's permit number
  • Payment information (processed securely; we do not store full card numbers)
  • Course progress, completion records, and assessment results
  • Communications you have with our staff
  • Website usage data (analytics)

How We Use Your Information:

  • To enroll you in and administer your course or service
  • To comply with TDLR and Texas DPS reporting requirements
  • To process payments and send receipts
  • To communicate with you about your enrollment, scheduling, and account
  • To improve our services and website
  • To send you updates or promotional communications (you may opt out at any time)

Sharing of Information: We do not sell, rent, or trade your personal information. We may share your information with: (a) Texas DPS and TDLR as required by law; (b) third-party service providers who assist in operating our business (under confidentiality agreements); (c) law enforcement if required by court order or applicable law.

Minors: For students under 18, we require parental or guardian consent. We take additional precautions to protect the information of minors in compliance with applicable law.

Data Security: We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access. However, no data transmission over the internet is 100% secure.

Your Rights: You may request access to, correction of, or deletion of your personal information by contacting us in writing. Note that we are required to retain certain records under TDLR regulations.

13 Intellectual Property

All content on the Texas Driving School website and within our courses — including but not limited to text, graphics, videos, course materials, logos, and software — is the exclusive intellectual property of Texas Driving School or its licensed content providers and is protected by applicable copyright, trademark, and other intellectual property laws.

  • Students are granted a limited, non-exclusive, non-transferable license to access and use course content solely for their personal, non-commercial educational purposes.
  • Students may not reproduce, distribute, publish, display, transmit, modify, create derivative works from, or exploit any course content without prior written consent.
  • Recording of online courses, lessons, or classroom sessions by students is prohibited without written permission.

14 Disclaimers

Texas Driving School provides driver education services in good faith and in compliance with applicable Texas law. However:

  • We do not guarantee that completing our courses will result in passing the Texas DPS knowledge or skills test. Results depend on individual student effort and performance.
  • Our website and course materials are provided "as is" without warranty of any kind, express or implied, including warranties of accuracy, completeness, or fitness for a particular purpose.
  • Texas Driving School is not affiliated with or endorsed by the Texas Department of Public Safety (DPS) or the Texas Department of Licensing and Regulation (TDLR), except as a licensed provider subject to their regulations.
  • We are not responsible for changes to DPS testing requirements, fee structures, or procedures that may occur after the date of your enrollment.

15 Limitation of Liability

To the fullest extent permitted by applicable law, Texas Driving School and its owners, officers, employees, instructors, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising out of or related to your enrollment, use of our services, or inability to use our services
  • Loss of data, loss of revenue, or personal injury not directly caused by our negligence
  • Actions of third parties, including the Texas DPS

In no event shall our total liability to you for any claim arising out of or related to these terms or our services exceed the amount you paid to us for the specific service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

16 Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or our services shall first be subject to good-faith negotiation between the parties. If a resolution cannot be reached within 30 days, disputes shall be submitted to binding arbitration in Denton County, Texas, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as a class or collective action.

17 Changes to These Terms

Texas Driving School reserves the right to modify these Terms and Conditions at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. We encourage you to review these terms periodically.

Continued use of our services after any changes become effective constitutes your acceptance of the revised terms. If you do not agree with any updated terms, you must discontinue use of our services and notify us in writing to exercise any refund rights that may apply.
